KinkPass

18 U.S.C. 2257 record-keeping compliance statement

KinkPass publishes adult content made by verified independent creators and studios. This statement explains how the service complies with the record-keeping requirements of 18 U.S.C. 2257 and 28 C.F.R. Part 75, who keeps the records, and how to send a records request.

Date of this statement Last updated October 19, 2026.

Every performer was an adult at the time of production

All persons who appear in any visual depiction of actual or simulated sexually explicit conduct available on kinkpass.com were 18 years of age or older at the time the depiction was produced. No content is published until the age and identity of every person who appears in it has been verified and documented.

Creators and studios are the producers of their content

KinkPass does not film or produce the content in its catalog. Each creator and each studio that uploads content is the primary producer of that content within the meaning of 18 U.S.C. 2257 and 28 C.F.R. Part 75, and is responsible for creating and maintaining the records the law requires for every performer in every upload.

Before any upload is published, the creator or studio provides KinkPass with copies of the required records for each performer. An upload without complete records is not published.

Records kept for each performer

For every performer in every published item, the records include at least the following.

  • A copy of a valid government-issued photo identification document
  • The performer's legal name and date of birth, as shown on that document
  • Every stage name, alias or professional name the performer has used
  • The date of production of the depiction
  • A signed consent covering the scene and its publication on KinkPass

Studios with several performers keep and submit these records per performer through their studio dashboard. Records are indexed by legal name, stage name and title of the work so that they can be located quickly.

Who keeps the records and how to make a request

The custodian of records for the copies held by KinkPass is the administrator of the kinkpass.com service. Requests concerning these records can be sent to [email protected]. Inspections by authorized government officials are handled as provided by 28 C.F.R. Part 75. Please describe the content concerned and include a link to it so that the correct records can be located.

The original records for each work are also maintained by the creator or studio that produced it, as primary producer.

Content not covered by these requirements

Some material on kinkpass.com is not subject to the record-keeping requirements of 18 U.S.C. 2257 and 28 C.F.R. Part 75, for example text pages, audio-only content, and visual material that does not depict actual or simulated sexually explicit conduct as defined by law. Public pages of the site contain no explicit imagery. KinkPass nevertheless applies the same age and identity verification to every person who appears in any visual content on the service, whether or not the law requires records for that specific item.
