How to send a takedown notice
Send your notice by email to [email protected] with the subject line "DMCA notice". Under 17 U.S.C. 512(c)(3), a valid notice must contain the following.
- A physical or electronic signature of the copyright owner or of a person authorized to act on their behalf
- Identification of the copyrighted work you claim is infringed, or a representative list if several works are involved
- Identification of the material on kinkpass.com that you claim is infringing, with the link to each item so that we can locate it
- Your contact information, including your name, postal address, telephone number and email address
- A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent or the law
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner or authorized to act on the owner's behalf
Incomplete notices may delay removal. We may ask you for the missing details before we act.
What we do with a valid notice
When we receive a complete notice, we remove or disable access to the material as fast as possible and tell the uploader that it was removed and why. A copy of the notice, which may include your contact details, can be shared with the uploader so that they can respond.
Knowingly misrepresenting that material is infringing can make you liable for damages under 17 U.S.C. 512(f).
How to send a counter-notice
If your content was removed and you believe this was a mistake or a misidentification, you can send a counter-notice to [email protected] with the subject line "DMCA counter-notice". It must include the following.
- Your physical or electronic signature
- Identification of the removed material and the location where it appeared before removal
- A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification
- Your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your address, or for any judicial district in which the service may be found if your address is outside the United States, and that you will accept service of process from the person who sent the original notice
After a valid counter-notice, we forward it to the person who sent the notice. The material may be restored in 10 to 14 business days unless they tell us they have filed a court action to stop the infringement.
Repeat infringer policy
Accounts that are the subject of repeated valid infringement notices are closed. A creator or studio account found to have uploaded work it does not own, or work containing a performer whose consent and records it does not hold, may be closed after a single notice.
Help for creators whose KinkPass content leaks elsewhere
If your KinkPass content appears on another site without your permission, write to [email protected] with the links you found. We help you prepare takedown notices to those sites and their hosts, using the upload records and publication dates we hold for your work. Content on the service is streamed to members and is not offered for download outside offline viewing in the app, which limits copying in the first place. More on creator protection is on the creators page and the safety page.
