Terms of service for members and creators

KinkPass contains adult content and is only for people who are at least 18 years old and old enough to view adult content where they live. By using the service you confirm that you meet these requirements and that viewing adult content is legal in your location. We may ask for additional age confirmation at any time.

You need an account to become a member. Give a valid email address, keep your password private, and do not share your account outside the number of simultaneous streams your plan allows. You are responsible for activity on your account. Tell us at [email protected] if you believe someone else has accessed it.

KinkPass is sold only as a recurring subscription. Yearly billing is the default and saves 50 percent compared with monthly billing.

• Creator Boost, an optional 5 USD per month recurring support for a creator you choose, 80 percent of which goes to that creator

The features of each plan are described on the pricing page. Prices are shown in US dollars and any applicable taxes are added at checkout. Charges appear on your statement under a discreet descriptor.

Your subscription renews automatically at the end of each billing period, monthly or yearly, at the price of your plan, until you cancel. The checkout and your confirmation email show the plan, price, period and renewal date. By subscribing you authorize us and our payment processor to charge your payment method for each renewal.

You can cancel at any time in your account settings. Cancelling stops future renewals, and you keep access until the end of the period you already paid for. Moving to a higher plan or from monthly to yearly billing charges the difference immediately.

Payments are final. Refunds are given only in the exceptions described in the refund policy, namely a double charge, a proven unauthorized charge, or a total failure of the service.

While your plan is active, we grant you a personal, non-transferable, non-exclusive and revocable license to stream content for your own private viewing. Offline viewing is available only inside the KinkPass app on plans that include it, and offline copies stop working when your plan ends. You may not download content outside the app, record or capture it, redistribute, resell, publicly show, upload elsewhere or remove watermarks from it. All rights in content stay with the creators and studios that made it.

Individual creators pay no monthly fee. KinkPass keeps 30 percent of the net subscription pool, and creators share the remaining 70 percent according to verified watch time, with a monthly statement. Studios use the Studio plan. Creators and studios must complete age and identity verification, provide signed consent and 2257 records for every performer before publication, and follow the content policy. Publishing on KinkPass is non-exclusive, so creators keep their other platforms. Full details are on the creators page and the payouts page.

• Use the service if you are under 18 or where adult content is illegal
• Share, resell or rent your account or exceed your plan's stream limit
• Copy, scrape, record or redistribute content
• Upload content that breaks the content policy, or content you do not own
• Harass, threaten or dox creators, performers or other members
• Interfere with the security or operation of the service, or attempt to access other accounts
• Use the service for any unlawful purpose

All content on KinkPass must follow the content policy. We may remove any content and suspend any account that we believe breaks it. You can report content through the reporting page.

We may suspend or close an account that breaks these terms, the content policy or the law, or that is used for fraud or abuse. A chargeback raised without first contacting us is a breach of these terms and may lead to closure. You may close your account at any time by writing to [email protected].

The service is provided as is and as available. To the extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the service will be uninterrupted or without errors, or that any particular content will remain in the catalog.

To the extent permitted by law, KinkPass is not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits or data. Our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim arose.

These terms are governed by the laws of the United States and of the state applicable to the operator of the service, without regard to conflict of law rules. Before starting any formal dispute, please contact us so that we can try to resolve it. Nothing in these terms limits rights you have under the mandatory consumer laws of your place of residence.
